ORDER
The petitioner is the accused in Crime No.900 of 2013 of Narakkal Police station registered under Sections 419, 468 and 471 of the Indian Penal Code and under Section 12(1)(b)(d) of the Passport Act, 1967.
2. The petitioner has filed this application under Section 438 of the Code of Criminal Procedure.
3. Heard.
4. The learned Public Prosecutor has no serious objection in allowing this application. The learned Public Prosecutor has submitted that the further action against the petitioner is likely to be dropped and a report in this regard had been already filed before the Superintendent of Police concerned for according sanction to file refer report before the court.
5. In view of the above submission of the learned Public Prosecutor, this application stands closed. However, I make it
B.A.No. 7550 of 2014 clear that if the respondents intend to arrest the petitioner, notice shall be given to the petitioner in advance, to enable the petitioner to approach this Court.
