Application for pre-arrest bail under Section 438 Cr.P.C. 2.

Petitioner apprehends arrest in Crime No.243/CR/PKD/04 of CBCID registered for offences punishable under Sections 120(B), 465, 468, 471 and 420 I.P.C. 3.

Heard the learned counsel for the petitioner and the learned Public Prosecutor.

Learned Public Prosecutor on instruction submitted that the petitioner is not arrayed as an accused in the crime. But the learned counsel for the petitioner submits that on 27-10-2003, a person had filed a complaint to the Secretary, Transport Department, Government of Kerala alleging that so many oil tankers are plying in the State with fake particulars like engine number, chassis number etc. on the vehicle. The petitioner was questioned so many times by Police in connection with the complaint Petitioner at that time owned two vehicles. The vehicles were later sold as scrap and the registration certificates of those vehicles have been cancelled. It is

B.A No.7617 of 2015 2 the allegation that the petitioner is now asked to produce those vehicles, which is an impossible act. Submission of the learned Public Prosecutor that she is not an accused is recorded. In case she is made an accused in the said case, the Investigating Officer shall issue notice to the petitioner under Section 41A Cr.P.C. With this observation, the bail application is closed.
