ORDER

Bail application filed under Sec.438 Cr.P.C.

2. The petitioner is the accused in crime no. 1004/2015 of Kanjiramkulam Police Station for the offence punishable under Sections 420 and 497 or Cr.P.C.

3. The allegation against the petitioner is that he is a TV technician. He went to the house of the de facto complainant, a married lady, and repaired her television. It is alleged to have been done five years back. It is further alleged that he threatened the de facto complainant by saying that he had installed a camera and by using that he had taken her nude photographs. Thereafter, he compelled her to undergo sexual intercourse on many occasions by extending threats.

4. Heard both sides.

5. The learned Counsel for the petitioner submitted that the petitioner is totally innocent and he has no connection with the de facto complainant. The

petitioner is the neighbour of de facto complainant.

6. Considering the nature of allegations, following directions are issued.

1. The petitioner shall surrender before the investigating officer within a period of two weeks and submit himself for interrogation.

2. In the event of arrest, the petitioner shall be released on his executing a bond for Rs.25,000/- (Rupees twenty five thousand only) with two solvent sureties each for the like sum to the satisfaction of the investigating officer.

3. The petitioner shall appear before the Investigating Officer between 10.00 a.m. and 11.00 a.m. on every Saturday till the final report is filed.

4. The petitioner shall not intimidate or attempt to influence the witnesses, nor shall they tamper with the evidence.

5. The petitioner shall co-operate with investigation of the case.

In case of violation of any of the above conditions, the learned Magistrate is empowered to cancel the bail in accordance with law without referring the matter to this Court.
