ORDER

Petition under Section 438 of the Code of Criminal Procedure. 2.

Petitioners apprehend arrest at the hands of Ottappalam Police.

Heard the learned counsel for the petitioners and the learned Public Prosecutor.

Learned Public Prosecutor submitted that the person named as second petitioner was found missing from 20-10-2015 onwards. The police has registered a crime under Section 57 of the Kerala Police Act in connection with that incident. First petitioner is not made an accused in this case. Therefore, viewing from any angle, the petition is not maintainable. Hence, the bail application is dismissed.
