O R D E R

The petitioner is the first accused in Crime No.96 of 2015 of the Excise Range, Koothuparambu registered for the offences under Sections 8(1) read with 8(2) and 55(g) of the Abkari Act on the allegation that on 23.102015, at about 10 p.m., the petitioner and the other accused were found in possession of 10 lires of arrack and utensils for the manufacture of arrack at a place in Poovathur, in contravention of the provisions of the Abkari Act. The petitioner was arrested from the spot and the other accused ran away from the scene.

2. Heard. The learned Public Prosecutor has no serious objection in allowing the application.

3. Considering the facts and circumstances of the case, including the period of detention of the petitioner, I am inclined to grant bail to the petitioner.

In the result, this application stands allowed and the petitioner shall be enlarged on bail on his executing a bond for Rs.30,000/- (Rupees thirty thousand only) with two solvent sureties each for the like amount to the satisfaction of the jurisdictional Magistrate and subject to the following conditions:

i. The petitioner shall report before the Investigating Officer on every Saturday between 9 a.m. and 11 a.m. for three months and thereafter, as and when required by the

ii.The petitioner shall not get involved in any other offence of similar nature while on bail.
