Bail application filed under Sec. 438 Cr.P.C. 2.
Petitioner is the first accused in Crime no. 3820 of 2015 of Kayamkulam Police Station, Alappuzha District, seeks pre-arrest bail. He is implicated in an offences punishable under Secs.332,294 and 506(i) read with Section 34 of the Indian Penal Code. It is alleged that on 17/11/2015 at 9 p.m., while the defacto complainant, who is an excise officer and his friends were having dinner in a hotel, the accused persons came there and abused the defacto complainant and his friends. They also threatened the defacto complainant and attempted to manhandle them.
3. Heard the learned counsel for the petitioner and the learned Public Prosecutor.

Considering the nature of allegations, I am inclined to grant anticipatory bail to the petitioners with the following conditions:
1. The petitioner shall surrender before the investigating officer within a period of two weeks and submit himself for interrogation.
2. In the event of arrest, the petitioner shall be released on their executing a bond for Rs.25,000/- (Rupees twenty five thousand only) with two solvent sureties for the like sum to the satisfaction of the investigating officer.
3. The petitioner shall appear before the Investigating Officer as and when directed and co-operate with the investigation.
4. The petitioner shall not intimidate or attempt to influence the witnesses, nor shall he tamper with the evidence.
5. The petitioner shall co-operate with the investigation of the case.
6. The petitioner shall not in any manner interfere or meddle with the investigation.
7.
Petitioner shall not, during the period of this bail get involved in any offence.
In case of violation of any of the above conditions, the learned Magistrate is empowered to cancel the bail in accordance with law without referring the matter to this Court.
