ORDER

Petition under Section 438 of the Code of Criminal Procedure. 2.

Petitioner is the accused in Crime No.3310 of 2015 of Pathanamthitta Police Station registered for an offence punishable under Section 306 I.P.C.

Heard the learned counsel for the petitioner and the learned Public Prosecutor.

The deceased married the accused on 21-05-2006. There is no issue born in the relationship. Husband of the petitioner committed suicide on 25-03-2015 from Behrin where he was employed.

Learned counsel for the petitioner based on the documents produced submitted that though he committed suicide on 25-03-2015, the complaint was filed only on 11-11-2015. That too after her petition before the Family Court seeking return of gold ornaments and money. This is only a counter blast to defeat her

B.A. No.7804 of 2015 2 claims. She has not committed any offence. Considering the nature of allegations, following directions are issued :

1. Petitioner shall surrender before the investigating officer within a period of two weeks from today and submit himself for interrogation. In that event, the petitioner shall be released on bail on executing a bond for Rs.50,000/- (Rupees fifty thousand only) with two solvent sureties each for the like sum to the satisfaction of the Investigating Officer. 2.

The sureties shall produce documents to establish their identity and solvency. The Investigating Officer need not insist on the solvency certificate, but other documents can also be perused to find out whether the sureties are solvent or not.

3.

Petitioner shall appear before the Investigating Officer as and when directed.

4.

Petitioner shall not influence or intimidate witnesses.

5. If any of the above conditions is violated by the petitioner, the learned Magistrate having jurisdiction is free to cancel the bail.
