Bail application filed under Sec.438 Cr.P.C.

2. Petitioner is the 2nd accused in Crime No.1728 of of Fort Police station, Thiruvanathapuram registered for the offences punishable under Secs.341, 323, 294(b), 324 and 354 read with Sec.34 of the Indian Penal Code. Prosecution case is that, on 09.08.2015, the defacto complainant and his wife was coming in an auto rickshaw and when he was about to park the same, the accused persons, who were consuming liquor nearby, intercepted the vehicle and dragged the defacto complainant. They attacked the wife of the defacto complainant too.

3. Heard the learned counsel for the petitioner and the learned Public Prosecutor.

4. Learned counsel for the petitioner submitted that as per order in B.A. No.7337 of 2015, this Court has granted pre arrest bail to the 1st accused.

5. Reckoning the entire facts and circumstances, pre arrest bail is granted to the petitioner with the following conditions.

(a) The petitioner shall surrender before the Investigating Officer within a period of 'two weeks' from today and submit himself for interrogation. Thereafter, he shall be released on bail on his executing a bond for Rs.25,000/- (Rupees twenty five thousand only) with two solvent sureties for the like sum to the satisfaction of the Investigating Officer.

(b) The petitioner shall appear before the Investigating Officer as and when required for the purpose of interrogation.

(c) The petitioner shall co-operate with the investigation of the case.

(d) The petitioner shall not intimidate or attempt to influence the witnesses.

Bail Appl. No.7817 of 2015 3 (e) The petitioner shall not in any manner interfere or meddle with the investigation.

(f) The petitioner shall not, during the period of this bail get involved in any other offence.

In case any of the above conditions is violated, bail granted hereby is liable to be cancelled for which the investigating officer may move application before the jurisdictional magistrate.
