Petitioners are accused in Crime Nos.763 and 764 of 2015 of Kumily Police registered for offences punishable under Sections 457, 461, 511 and 380 read with Section 34 of the Indian Penal Code. They seek bail.

Allegation in one case is that the petitioners along with other accused persons broke open the window panes of a service co-operative bank and in the other case, they broke open the vicar's room of a church and committed theft.

Heard both sides.

Petitioners were arrested on 14.10.2015 and they have completed 60 days in custody. Admittedly charge has not been filed in these matters. Hence the following order:
i.
Petitioners shall be released on bail on each one of them executing a bond for `50,000/- (Rupees fifty thousand only) with two solvent sureties each for the like sum to the satisfaction of the learned
BA NoS.7837 & 7838/2015 Magistrate having jurisdiction.
ii.
The sureties shall be natives of State of Kerala. They shall produce documents to establish their identity and solvency. The lower court need not insist on the solvency certificate, but other documents can also be perused to find out whether the sureties are solvent or not. iii.
Petitioners shall appear before the Investigating Officer on all Mondays and Thursdays between 10.00 and 11.00 a.m until final report is filed.
iv.
Petitioners shall not indulge in any offence while on bail. v.
They shall not influence or intimidate the witnesses or meddle with the investigation in any manner.
vi.
They shall furnish their local address and mobile number to the investigating officer in each case.
If any of the above conditions is breached by the petitioners, the lower court concerned is free to cancel bail without referring the matter to this Court.
