ORDER

Application for bail under Section 439 of the Code of Criminal Procedure.

Second accused in Crime No.3363 of 2015 of Kalady Police Station registered for offences punishable under Sections 323 and 308 read with Section 34 of the Indian Penal Code seeks bail.

Allegation is that on 20.11.2015 at 2.45 p.m., accused persons questioned the defacto complainant and his friend and with an intention to commit culpable homicide, attacked them with a knife and attempted to inflict a stab injury. In that process, a deep injury on the left arm was sustained by the defacto complainant.

Heard both sides.

Learned Prosecutor opposed the bail application. It is submitted that a final report has already been filed in this case. Further the petitioner is involved in five other cases and proceeded under Section 107 of the Code of Criminal Procedure.

Considering the antecedents and the fact that final report has been filed, I am not inclined to grant bail to the petitioner. Application is dismissed. A. HARIPRASAD, JUDGE.
