This is an application filed under Section 438 of the Code of Criminal Procedure.

When the petition came up for hearing, the learned counsel for the petitioners submitted before me that considering the laceration on the head of the defacto complainant, the prosecution incorporated an offence under Section 326 of IPC.
At this juncture, the learned Public Prosecutor submitted that crime for an offence under Section 326 is not registered against the petitioners. If that is so, it can be seen that all the offences are bailable one.
