O R D E R
The petitioner is the sole accused in crime No.821 of 2014 of Perunad Police Station registered under Sections 468 and 471 of I.P.C.
2. The prosecution allegation is that the petitioner created possession certificate, forging the signature and seal of the Village Officer and produced the same before the State Bank of Travancore, Vadasserikkara branch for availing a loan. The petitioner has filed this application praying for the relief under Section 438 Cr.P.C.

4. The learned Public Prosecutor has opposed the application. The offence alleged against the petitioner is grave in nature. The investigation has to be conducted to ascertain as to whether any other person is also involved in this case. Whether the petitioner is involved in any other offence of similar nature is also to be investigated. Considering the nature and gravity of the allegations raised against the petitioner, I am of the view that custodial interrogation of the petitioner is necessary for the progress of investigation of the case. The recovery also has to be effected. Considering the nature and gravity of the allegations raised against the petitioner, I am not inclined to grant the relief under Section 438 Cr.P.C. in favour of the petitioner.
In the result, this application stands dismissed.

However, the petitioner shall be at liberty to surrender before the Sub Inspector of Police, Perunad Police Station within ten days from today, if so advised. In the event of such surrender by the petitioner, the Sub Inspector of Police shall produce the petitioner before the jurisdictional Magistrate after interrogation. If the petitioner files any application for bail on her production before the jurisdictional Magistrate, the learned Magistrate shall consider and dispose of the application for bail, in accordance with law, as expeditiously as possible.
