Application for bail under Section 439 Cr.P.C. 2.

Petitioner is the 6th accused in Crime No.889/2015 of Varantharappilly Police Station registered for an offence punishable under Section 395 I.P.C.

Heard the learned counsel for the petitioner and the learned Public Prosecutor.

Prosecution case, in short, is that on 25-11-2015 at about 10.30 p.m., the petitioner along with other accused persons, wrongfully restrained the defacto complainant and by putting him in fear of death, took away Rs.1,000/- from his pocket. Further, the accused persons demanded Rs.10,000/-. They threatened to set fire to the motorcycle of the defacto complainant.

Learned Public Prosecutor opposed the bail application. It is submitted that the petitioner is involved in seven other crimes and he is booked under the KAPA also. Considering the antecedents of the petitioner and the stage of investigation, I am not inclined to grant bail to the petitioner. Hence, bail application is dismissed.
