O R D E R

The petitioner is the sole accused in Crime No.1275/2014 of Cantonment Police Station registered under Sections 341 and 353 of I.P.C.

2. The prosecution case is that on 25.10.2014 at 5 p.m., the petitioner, who was on security duty in the District Hospital Service Transport workshop, prevented the entry of the District Collector into the said workshop for inspection and thereby deterred the District Collector from discharging his official duty. The petitioner has

filed this application for the relief under Section 438 Cr.P.C.

3. Heard.

4. The learned Public Prosecutor has no serious objection in allowing this application.

5. It has been submitted by the learned counsel for the petitioner that as per the direction of this Court dated 9.12.2014, the petitioner tendered unconditional apology before the District Collector concerned and the same was accepted by the District Collector. Considering the facts and circumstances of the case, including the above submission of the learned counsel for the petitioner, I am inclined to grant the relief under Section 438 Cr.P.C. in favour of the petitioner.

In the result, this application stands allowed and it is directed that the petitioner shall be released on bail in the

event of his arrest in connection with Crime No.1275/2014 of Cantonment Police Station on condition of the petitioner executing a bond for `30,000/- (Rupees thirty thousand only) with two solvent sureties, each for the like sum to the satisfaction of the 2nd respondent, before whom the petitioner shall surrender within 10 days from today and subject to the following conditions:

(i) The petitioner shall report before the Investigating Officer as and when required by the Investigating Officer for interrogation.

(ii) The petitioner shall not get involved in any offence while on bail.
