ORDER

This is an application seeking anticipatory bail under Section 438 of the Code of Criminal Procedure. Petitioner is one of the Directors of a Private Limited Company viz. M/s petitioner Mathai Construction Company Pvt Ltd, which is constituted under the Indian Companies Act, 1956. It is alleged that the petitioner was called for a discussion on 09.07.2014 at the Regional Office, South Indian Bank Ltd at Kakkanad. During the discussion, the petitioner was informed that the Bank is proposing to take legal action against all the four Directors of P.T Mathai Construction Co.Pvt.Ltd and Mrs.Achamma Giju (wife of Mr.Giju) in the matter of illegal transfer of title. On the impression that he will be arrested in a non-bailable matter, this petition is filed seeking anticipatory bail.

2. The learned Public Prosecutor submitted that no crime is registered against the petitioner in Mulamthuruthy Police Station in the alleged matter. In the result, the bail application is closed. Sd/- MARY JOSEPH, JUDGE vdv
