Petition filed under Section 439 Cr.P.C.

Petitioner is the second accused in Crime No.1688/2014 of the Pathanamthitta Police Station registered for the offences punishable under Sections 342, 342, 506(ii), 307, 120B, 364, 326 and 201 read with Section 34 of the Indian Penal Code.

The allegation against the petitioner is that he along with the other accused abducted the defacto complainant, in pursuance of a criminal conspiracy hatched among them on 08.11.2014 after 11 p.m., and they took him to an uninhabited house. It is alleged that it was the petitioner who tied his hands and legs and thereafter the

B.A.No. 8900 of 2014 -: 2 :- petitioner along with A1 severely beat the defacto complainant on both his hands and legs with iron rod thereby causing fracture of his right elbow, right leg and also left hand. Petitioner has been in custody for the period from 24.11.2014 onwards.

Heard learned counsel for the petitioner and the learned Public Prosecutor. Perused the CD.

The contents of the CD, prima facie, reveal the complicity of the petitioner. Over and above the present case, the petitioner is accused in three other cases, viz., Crime No.1094/11 of the Pathanamthitta Police Station for the offence punishable under Section 376 of the Indian Penal Code, Crime No.1255/10 under Section 324 IPC which is presently pending as C.C.No.390/2010 and Crime No.385/11 under Sections 341, 323, 324 read with Section 34 IPC. It seems that the petitioner is a hardened criminal involved in series of serious criminal cases. The allegation against the petitioner is very grave and serious. Considering

B.A.No. 8900 of 2014 -: 3 :- the seriousness of the allegations against the petitioner, I am of the view that the petitioner is not entitled to be enlarged on bail.
