O R D E R

Petition filed under Section 438 Cr.P.C.

The petitioner is the first accused in crime No.1331/2014 of Pavaratty Police Station, which has been registered for the offence under Section 420 of IPC. 2.

The petitioner does the work of interior decoration. He entered into an agreement with the defacto complainant. The total remuneration was about Rs.40 lakhs. The defacto complainant alleges that the petitioner collected from him Rs.50 lakhs and the quality of the articles used is substandard and he has thus cheated him.

Having regard to the nature of the allegations, it appears that detention of the petitioner is not necessary. It is sufficient that conditions are imposed for effective interrogation of the petitioner. So I am inclined to grant the

B.A. No.8904 of 2014 -2prayer of the petitioner.

In the result, this application is allowed.

1) The petitioner shall be released on bail after interrogation on his executing a bond for Rs.1,00,000/- (Rupees one lakh only) with two solvent sureties each for the like sum if he is arrested by the police in connection with this case. 2) He shall appear before the Investigating Officer for interrogation if he is so required by him in writing. 3) He shall not intimidate or attempt to influence the witnesses; nor shall he tamper with the evidence. 4) He shall co-operate with the investigation.

This order is not applicable if the petitioner chooses to surrender before the Magistrate concerned and in such case the learned Magistrate may take appropriate action in accordance with the law.
