Petitioner is the accused in Crime No.1094/2011 of the Pathanamthitta Police Station registered for the offence punishable under Section 376 of the Indian Penal Code.

The allegation against the petitioner is that he continuously conducted penetrative sexual assault on a minor girl aged 15 and he stayed along with her for a long period. Petitioner has been in custody for the period from 24.11.2014 onwards.

Heard learned counsel for the petitioner and the learned Public Prosecutor. Perused the CD.

The contents of the CD, prima facie, reveal the complicity of the petitioner. Over and above the present
B.A.No. 8905 of 2014 -: 2 :- case, the petitioner is accused in three other cases, viz., Crime No.1688/14 of Pathanamthitta Police Station for the offences punishable under Sections 120B, 364, 342, 324, 506(ii), 326, 307, 201 read with Section 34 IPC, Crime No.1255/10 under Section 324 IPC which is presently pending as C.C.No.390/2010 and Crime No.385/11 under Sections 341, 323, 324 read with Section 34 IPC. It seems that the petitioner is a hardened criminal involved in series of serious criminal cases. The allegation against the petitioner is very grave and serious. Considering the seriousness of the allegations against the petitioner, I am of the view that the petitioner is not entitled to be enlarged on bail.
