B.A.No.9113 of 2014 is filed by the second accused and Crl.M.C.7345 of 2014 is filed by the first accused in S.C.No.476/2013 of the Sessions Court, Thalassery. On hearing the learned counsel appearing for the petitioners, it is appropriate to dismiss the Bail Application as well as the Crl.M.C., as withdrawn. Hence, B.A.No.9113/14 and Crl.M.C.7345/2014 are dismissed as withdrawn, with liberty to the petitioners to approach the court below with applications seeking bail.

It is made clear that the withdrawal of the B.A. And the Crl.M.C. or the dismissal of the earlier applications, shall not

B.A.No.9113/14 & Crl.M.C.7345/2014 -: 2 :- stand in the way of considering their Bail Applications, if any filed before the court below, by the court below. The trial court can take an independent view in the matter, quite untrammeled by the findings or observations made by this Court.
