Petition under Section 439 Cr.P.C.

Petitioner is the 2nd accused in Crime No.1552/2014 of the Taliparamaba Police Station, Kannur registered for the offence punishable under Section 21B of the Narcotic Drugs and Psychotropic Substances Act,1985. 3.

The allegation against the petitioner and the other accused is that on 06.12.2014 they were found in possession of 12.190 grams of brown sugar, which is intermediate quantity, and the same was separately packed in 141 paper packets, evidently for sales and distribution. The petitioner was arrested on 07.12.2014 and thereafter he has been in custody.

Heard the learned counsel for the petitioner and the learned Public Prosecutor. Perused the CD. 5.

The contents of the CD, prima facie, reveal the complicity of the petitioner. The allegations against the petitioner are very grave and serious. Investigation of this case not over. Considering the seriousness of the allegations against the petitioner, this Court is of the view that the petitioner is not entitled to be enlarged on bail.
