JUDGMENT

This appeal is preferred against the judgment in C.C.1974 of 2002 of Additional Chief Judicial Magistrate, Ernakulam. The above case was filed under Section 138 of N.I.Act. On 10.2.2004, the complainant was absent and there was no representation. The learned counsel for the complainant was also absent. On that ground, the accused was acquitted under Section 256(1) Cr.P.C. Against that order, appellant preferred this appeal. Leave granted on 26.3.2004. When this appeal came up for hearing, this court directed to issue notice to the respondent on 31.3.2004. Even after that direction, no steps are taken to issue notice to the respondent.

Today when the matter came up for hearing, there is no representation and no steps taken so far. Hence this appeal is dismissed for non prosecution.
