JUDGMENT

This Criminal Appeal is preferred against the order in C.C.No.2128/2003 of the Judicial First Class Magistrate Court-I, Kollam. When the matter came up for hearing, the learned counsel for the appellant submitted that the accused is no more and on the basis of that information, this Court directed the C.I. of Police, Kollam West Police Station to produce the death certificate of the accused. Accordingly, the death certificate of V. Gangadharan Pillai is produced by the Public Prosecutor, which was marked as Ext.C1. As per the death certificate, the accused died on 25.1.2010. In the

Crl. Appeal No.617/2009 circumstances, the Criminal Appeal is dismissed as abated u/s.394 of the Code of Criminal Procedure.
