--------------------------------------- Crl.M.C No.253 of 2015 --------------------------------------- Dated this the 15th day of January, 2015 O R D E R The petitioner herein is the original 3rd accused in C.C No.1861/2013 of the Judicial First Class Magistrate Court, Chavakkad. The offences involved in the crime (Crime No.141/2012 of the Guruvayoor Police Station) are under Sections 420, 465, 468, 471 and 120(b) r/w 34 of the Indian Penal Code. The case against the original accused Nos.1 and 2 in C.C No.1861/2013 was quashed by this Court, on the ground of amicable settlement made between the parties as per order dated 2.6.2014 in Crl.M.C No.2260/2014. The case against the petitioner herein was split up and refiled as C.C No.2624/2014. Now the case against him is also sought to be quashed on the ground of amicable settlement.
The defacto complainant, who made complaint is the 2nd respondent herein. He has filed affidavit to the effect that he has settled the whole dispute with the accused, and he has no complaint or grievance now.
Crl.M.C No.253 of 2015 be quashed, as done in the case of the other accused. In the result, this Criminal Miscellaneous Case is allowed. The prosecution against the petitioner herein in C.C No.2624/2014 before the Judicial First Class Magistrate Court, Chavakkad, will stand quashed under Section 482 of the Code of Criminal Procedure. Accordingly, the petitioner will stand released from prosecution, and the bail bond, if any, executed by him will stand discharged.
