O R D E R
Petitioner is the second accused in Crime No.77/2013 of Rajapuram Police Station, Kasaragod District registered for the offences punishable under Sections 376,506(ii) and Section 3(1) (xii) of the Scheduled Castes and Scheduled Tribes Prevention of Atrocities Act 1989. The petitioner is a woman who had allegedly taken the victim to her own house thereby enabling the first accused to commit rape on the victim. The matter is presently pending as C.P 2014/2014 before the Judicial First Class Magistrate's Court-I, Hosdurg.
2. Heard the learned Counsel for the petitioner and the learned Additional DGP.
3. The limited prayer of the petitioner is that the
application seeking bail that may be filed by her may be disposed of by the court below on the very same day it is filed.
This Crl.M.C is disposed of by directing the court below to dispose of the application seeking bail that may be filed by the petitioner on her surrender before the court below, preferably on the date of surrender itself, provided advance notice has been served on the Assistant Public Prosecutor in charge of the case.
