--------------------------------------- Crl.M.C No.534 of 2015 --------------------------------------- Dated this the 3rd day of February, 2015 O R D E R The petitioner herein seeks a direction under Section 482 of the Code of Criminal Procedure to the Judicial First Class Magistrate Court, Nilamboor for expeditious consideration and disposal of her application made under Section 457 of the Code of Criminal Procedure. Annexure A3 is the copy of the said application. As required by the Court, the learned Magistrate submitted report before this Court that the case now stands posted to 12.2.2015 for report of the Assistant Motor Vehicle Inspector. The report also shows that the court has issued notice to the accused in the crime. Anyway, the petition is being considered by the learned Magistrate. At this juncture it would be inappropriate to make a direction for time bound disposal. However, the court below can be directed to decide the claim at the earliest.
In the result, this Criminal Miscellaneous Case is closed with direction to the court below that the petitioner's claim under Section 457 of the Code of Criminal Procedure shall be heard and decided at the earliest.
