O R D E R

The petitioner herein is the second accused in Crime No.399 of 2011 of Mavelikara Police Station registered under Sections 406 and 420 of the Indian Penal Code. He seeks orders quashing the F.I.R and further proceedings in the crime. Now there is a report that the investigation is in progress and the Investigating Officer requires some more time to submit final report. In such a circumstance, the Crl.M.C can be disposed of with direction to the Investigating Officer to submit final report within three months and also without prejudice to the right of the petitioner to seek appropriate relief as regards the final report, if he is aggrieved by the final report. The petitioner will have to approach the trial court for releasing his passport and other documents. If relief is denied, the petitioner can approach this Court. With the above observations, this Crl.M.C is disposed of, directing the Police to submit final report in the crime within three months from today.
