--------------------------------------- Crl.M.C No.1009 of 2015 --------------------------------------- Dated this the 27th day of February, 2015 O R D E R The petitioner herein is the accused in S.C No.685/2005 of the Vth Additional Sessions Court, Palakkad. Trial in the said case is over, and the case now stands posted for hearing. At the fag end the petitioner's counsel relinquished vakalath. In such a situation, he made an application before the learned trial judge for some reasonable time to appoint another counsel. The petitioner's request here is to direct the learned trial judge to allow his request and to grant reasonable adjournment to make arguments. Now there is a report from the trial court that the learned trial judge has already considered the petitioner's grievance and granted time to appoint another counsel.

In such a situation, this Criminal Miscellaneous Case need not proceed. However, the learned counsel for the petitioner submits that the newly appointed counsel will require some reasonable time to get prepared for arguments, and so the trial court may be directed to grant a short adjournment. This Court need not issue such a direction.

Crl.M.C No.1009 of 2015 counsel wants some time to get prepared for arguments, he can very well make an application before the learned trial judge. It is submitted that he will make arguments in the 1st week of March. No doubt, his request, in the special circumstances will be considered by the learned trial judge.

In the result, this Criminal Miscellaneous Case is closed.
