Petitioner is the accused in CC.No.1805/2015 on the file of the Judicial First Class magistrate Court-I, Hosdurg. He is charged with having committed certain offences under the Kerala Protection of River Banks and Regulation of Removal of Sand Act and Mines and Minerals Development and Regulation Act. The prayer is to quash the proceedings on the ground that no offence is made out against him.

The prayer to quash the proceedings is made on the ground that the prosecution documents do not disclose commission of the offences. If that is true, the petitioner may plead for discharge. The learned Magistrate shall decide the question on merits.
