O R D E R

The petitioner herein claims to be the registered owner of the vehicle No.KL-13N 1656, seized by the Adhur Police in Crime No.81 of 2015. He wants to make an application for interim custody of the vehicle under Section 451 of the Code of Criminal Procedure. Now there is a report that the crime stands transferred to the Kannur Town Police Station.

The learned Public Prosecutor submits that the vehicle will be soon produced before the learned Magistrate at Kannur. In such a situation, this Crl.M.C can be closed directing the petitioner to approach the learned Judicial First Class Magistrate Court, Kannur with necessary application under Section 451 of the Code of Criminal Procedure. If such an application is already pending there, it will have to be considered by the learned Magistrate judiciously, and if the petitioner is entitled to claim custody of the vehicle, the vehicle can be released to the petitioner

Crl.M.C No.1715 of 2015 on appropriate reasonable conditions.
