O R D E R

The petitioner herein is the accused in C.C.No.295/2012 of the Judicial First Class Magistrate Court, Thaliparamba, involving the offences punishable under Sections 336 and 338 IPC. The injured in this case is a small child aged nine years at the time of the accident. The alleged road traffic accident occurred on 04.07.2011. The injured is still a minor. Now, the parties have come to terms amicably out of court. The petitioner seeks orders quashing the prosecution on the ground of such amicable settlement. The First Information Statement in this case was given by a teacher of the school, wherein the injured child studies. The 3rd respondent herein is the first informant. The 2nd respondent herein is the mother of the injured child. She has come to terms amicably with the accused in the best interest of the child. She has filed affidavit to the effect that the whole dispute stands now settled, and she has no grievance or complaint now. The first informant teacher also filed affidavit to the effect that the dispute stands settled and resolved forever. I

Crl.M.C.No.1955 of 2015 am well satisfied that the settlement will not, in any manner, affect the right of the minor. The mother of the minor has come to terms with the accused in the best interest of the minor. I am well satisfied that there is a real and genuine settlement between the parties. Applying the decisions of the Honourable Supreme Court on the point, this prosecution can be quashed as requested. This does not involve any public interest or public issue. In the result, this petition is allowed. The prosecution against the petitioner in C.C.No.295/2012 will stand quashed under Section 482 Cr.P.C.
