O R D E R
The petitioners herein are the accused Nos. 2 and 3 in Crime No.89 of 2015 of the Valayar Police Station registered under Sections 406, 408, 420, 468, 471 r/w 34 of IPC. They were granted pre-arrest bail by the Court of Session, Palakkad as per the order dated 24.2.2015 in Crl.M.C No.453 of 2015, on certain conditions. One of the conditions is that the petitioners shall report before the Investigating Officer between 10 a.m and 12 noon on all Saturdays for a period of one month, thereafter on all alternative Saturdays between 10 a.m and 12 noon for a period of two months, and thereafter, as and when required by the Investigating Officer. The petitioners filed an application before the court of Session for modification of the said condition as Crl.M.P 799 of 2015. On 25.3.2015 the learned Sessions Judge dismissed the application for modification. Now the accused are before this court under Section 482 Cr.P.C. On hearing both sides, I find that the condition imposed by the
Crl. M.C No.2150 of 2015 court below can be reasonably modified. The crime was registered in early January 2015 on the basis of a complaint forwarded for investigation from the court. I think that the police must have completed substantial part of investigation. In such a situation, rigorous condition need not continue in force. It will suffice that the petitioners report before the Investigating Officer once in a month till the investigation is over, or till the condition is otherwise modified by this court or the court of Session.
In the result, this petition is allowed. The condition imposed by the court below that the petitioners shall report before the Investigating Officer will stand modified to the effect that the petitioners shall so report between 10 a.m and 11.am on the second Saturday of every English month, till investigation is over.
