O R D E R

The petitioner, the first accused in C.C.409/2013 has filed this Crl.M.C. Seeking a direction that the bail application, to be submitted by him may be considered on the same day on which he surrenders himself to the Judicial First Class Magistrate's Court I, Perinthalmanna. The petitioner is accused of offences under Sections 323, 341, 506(i), 498A, 406 read with Section 34 Indian Penal Code. The defacto complainant is the wife of the petitioner. She had alleged matrimonial cruelty and harassment from the petitioner. According to the petitioner he was abroad and therefore, had not appeared before the Trial Court. He is ready to surrender before the said court. He only seeks a direction that the application for bail to be moved by him, be considered on the

Crl.M.C.No:2480/2015 same day of the surrender itself.

2, Heard the Public Prosecutor as well as the counsel for the petitioner. In view of the circumstances referred to above this Crl.M.C. is allowed. The Judicial First Class Magistrate's Court, Perinthalmanna is directed to consider the bail application to be moved in C.C.409/2013 pending before it and to finally dispose of the same on the same day on which the petitioner surrenders himself before the said Court. The Crl.M.C is allowed as above.
