ORDER
This Criminal M.C. has been instituted under Section 482 of the Code of Criminal Procedure seeking the invocation of the inherent powers conferred on this Court with the following prayer.
"This Hon'ble Court may be pleased to quash the entire proceedings as against the petitioner in S.C.No.878/2014 on the files of the Additional Sessions Court-I, Kollam, in the best interest of justice."
2. Heard Mr.Sunil V. Mohammed, the learned counsel for the petitioner and Smt.Hyma, the Public Prosecutor for the respondent, State of Kerala.
3. Both sides submits that final report has already filed in this case and the matter is now posted to 12.6.2015 for framing charges of this case.
4. Sri.Sunil V. Mohammed, the learned counsel for the petitioner submits that the petitioner is not pressing this Criminal M.C. as he has been advised to
Crl.M.C.No.2495 of 2015 seek the remedy of filing necessary application seeking discharge before the court below concerned. Accordingly, in view of the submissions, this Criminal M.C. is closed as not pressed, with aforementioned liberty to the petitioner, provided the stage for seeking such relief of discharge has not been crossed.
