ORDER
The limited prayer made by Sri.Latheesh Sebastian learned counsel appearing for the petitioner is that this Court may issue necessary orders to direct the Jurisdictional Magistrate concerned to consider the bail application of the petitioner on the same day itself, on the petitioner appearing before the learned Magistrate concerned in this crime. Accordingly it ordered in the interest of justice that, in the event of the petitioner voluntarily surrendering before the Judicial First Class Magistrate Court, Ottappalam dealing with Annexure A1 FIR in Crime No.333/2015 of Shornur Police Station without further delay and submits necessary application for grant of bail, then the learned Magistrate concerned shall consider the application on the same day itself and in accordance with law and after taking into account the facts and circumstances of the case. The petitioner will give advance notice to the prosecutor concerned attached to the court below concerned at least 24 hours prior to such
Crl.M.C. No.3269 of 2015 2 proposed appearance before the learned Magistrate concerned. Petitioner may appear before the learned Magistrate within a period of fifteen days from today.
2. Learned Prosecutor submits that in view of the above said direction, no further coercive steps will be taken by the Investigating Agency against the petitioner in this crime until the matter is considered by the learned Magistrate as directed above. It is made clear that if the petitioner does not voluntarily surrender before the jurisdictional Magistrate concerned within a period of fifteen days from today, the directions stipulated herein above is automatically vacated.
With these observations and directions the Crl.M.C.stands finally disposed of.
