ORDER

This revision petition is preferred against the judgment in Crl. Appeal 22/96 on the file of the Addl. Sessions Judge, Fast Track Court-I, Trivandrum, challenging the concurrent conviction under Section 16(1) (a)(i) (ii) r/w 2 (ia)(a)(m):7(i)(iii) of the Prevention of Food Adulteration Act.

When the matter is came up for hearing, the learned counsel appearing for the revision petitioner submits that revision petitioner died on 9.11.12. On the basis of that submission, this court directed the Inspector of Police, Venjaramoodu to collect the death certificate of Sri.M.Gopinathan Nair. Accordingly, he filed a report with death certificate which is marked as Ext.C1, in which it is specifically stated that he died on 9.11.12. In revision petition, there is no abatement, but the counsel submitted that, there is no meaning in proceeding with the matter.

Crl.R.P.3011 of 2003 2 Revision petitioner has already deposited a fine of Rs.1000/- in the trial court. In the light of the above submission, this revision petition is closed for nonprosecution. Sd/- P.D. RAJAN, STK JUDGE //TRUE COPY// P.A. TO JUDGE
