Sri.John Mathew, learned counsel appearing for the petitioner submits that this petition was drafted with the averment that the impugned order of transfer of the case was ordered by the Principal Sessions Judge concerned and that only later, the petitioner has come to know that the impugned order was on the basis of the decision taken by the Hon'ble Portfolio Judge of this Court having administrative jurisdiction over the District concerned and that therefore leave may be granted to the petitioner to withdraw this Crl.M.C. with liberty to file a fresh appropriate petition containing the correct factual details and to challenge the impugned action accordingly, etc.
