O R D E R
This petition is filed by the petitioner seeking modification of the condition imposed by the trial court while granting anticipatory bail under section 482 of the Code of Criminal Procedure.
2. It is alleged in the petition that the petitioner was granted bail by the Sessions Court, Thrissur as per Annexure-A1 order with conditions interalia directing the second petitioner, who is the petitioner herein, to report before the investigating officer every Monday between 9 a.m and 10 a.m for a period of three months and thereafter as and when required by the investigating officer in writing to do so. The petitioner filed Crl.M.P.No.2756/2015 for lifting that condition but that was dismissed by the court below by Annexure-A2 order. So the petitioner has approached this Court for modification of the condition imposed.
3. Heard both sides.
When this petition came up for hearing today, learned
Public Prosecutor submitted that investigation in this case has already been completed and final report has been filed before the Judicial First Class Magistrate Court, Irinjalakuda and it was taken on file as C.C.No.3769/2015. So there is no necessity to modify the condition arises as the condition will be in force till the investigation is completed. So under the circumstances, the prayer in the petition has become infructous and the petition is dismissed as infructous.
