ORDER
The petitioners herein are the two accused in Crime No. 533 of 2015 of Anchalummoodu Police Station registered under Sections 498A and 323 of IPC. They now want to go abroad, and they seek a direction to the learned Magistrate having jurisdiction, to issue a No Objection Certificate. It is not known whether the petitioners have already approached the learned Magistrate. The crime involves only offences triable by the Judicial First Class Magistrate. This Court finds that there is no reason to interfere at this stage under Section 482 Cr.P.C. The request to issue passport will have to be considered by the appropriate Court that will have to try the case. If the petitioners could not obtain orders from the Court below, they can very well approach this Court. Anyway, the petitioners will have to approach the learned
Crl.M.C.No.6417 of 2015 2 Magistrate having jurisdiction, and make appropriate application.
