O R D E R

The petitioner herein is the sole accused in S.C No.1858/2013 of the 1st Additional Sessions Court (Special Court for cases relating to Atrocities and Sexual Violence against Women and Children), Thiruvananthapuram. He seeks a direction under Section 482 of the Code of Criminal Procedure for an expeditious trial and disposal of the case. As required by this Court, the learned trial judge submitted a report dated 14.10.2015, regarding the total pendency there and the present stage of the case. The learned trial judge has reported that the total pendency in the said court is 2256 cases as on 31.9.2015 and that the oldest case is that of the year 2004. The petitioner's case is that of 2013.

When thousands and lakhs are waiting for justice in different courts, and when the alarming pendency in the court below is 2256 cases, it would be quite unjust and inappropriate to direct the court below to dispose of the petitioner's case out of turn. However, the learned trial judge has reported that earnest efforts will be made to dispose of the case by February 2016. The said report is recorded, and this Crl.M.C is closed.
