ORDER

Crl.M.A. No. 5249 of 2015 has been filed jointly by the nd respondent, who is the revision petitioner herein and the 2 de facto complainant in C.C. No. 613 of 2008 on the files of the Court of the Judicial Magistrate of the First Class-I, Haripad praying for recording the composition. The offence alleged is the offence under Section 379 of IPC, which is compoundable under Section 320 (b) Cr.P.C. There is no material before the court to show that the revision petitioner has been convicted in any other offence. It has been submitted by the learned nd respondent that this petition has been filed counsel for the 2 nd respondent.

2. Considering the facts circumstances of the case including the fact that the present petition has been filed voluntarily by the parties, I am inclined to grant permission to compound the offence. Accordingly, permission stands granted and the composition stands recorded, which is having the effect of acquittal under section 320 (8) of Cr.P.C.
