O R D E R
Petitioners 1 to 3 are the accused and petitioners 4 and 5 are the defacto complainant and the injured witness in Crime No.237 of 2014 of the Railway Police Station, Kozhikode, for the offences punishable under Sections 294(b), 341, 323 and 506(i) read with Section 34 IPC. Offences alleged, except the one under Section 294(b) IPC, are compoundable. The parties have settled the matter amicably. On going through the matter, it seems that there are no sufficient ingredients to invite an offence under Section 294(b) IPC in the matter. Both the accused as well as the defacto complainant and the other injured witness
Crl.M.C. No.6909 of 2015 have filed joint petition for getting Annexure-I First Information Report and all further proceedings based on it, quashed. When the matter has been amicably settled between the parties, no purpose would be served in proceeding with the matter any further. Matters being so, Annexure-I First Information Report in Crime No.237 of 2014 of the Railway Police Station, Kozhikode and all further proceedings based on it can be quashed.
In the result, this Crl.M.C. is allowed and Annexure-I First Information Report in Crime No.237 of 2014 of the Railway Police Station, Kozhikode and all further proceedings based on it are hereby quashed.
