~ ~ ~ ~ ~ ~ Heard learned counsel for the petitioner, learned counsel for the 2nd respondent and learned Public Prosecutor.

According to the petitioner, the allegations against the petitioner will not constitute an offence under Section 138(a) of the Indian Electricity Act, 2003. On going through the allegations, it seems that presently, it is too premature to consider the question. According to the learned counsel for the petitioner, there are contradictions between the earlier statement of the de facto complaint and the subsequent complaint in the matter. Those matters require evidence. When it is a matter to be proved through

evidence, the present stage is too premature to consider the said question.

With liberty to the petitioner to take up the very same contentions before the court below during trial, this Crl.M.C. is closed.
