O R D E R
The petitioner herein is the sole accused in C.C.No.1297/2012 of the Judicial First Class Magistrate Court-II, Kochi, involving the offences under Sections 403, 406, 415 and 420 IPC. Crime in the said case was registered on the complaint of the 2nd respondent herein. The accused brought this proceeding under Section 482 Cr.P.C. to quash the prosecution, on the ground that the complaint made by the 2nd respondent will not reveal any such offence. Pending this proceeding, the matter was referred to mediation on the request of both the parties, on the finding that there are elements of settlement, and that the whole dispute could be resolved forever by effective mediation. Accordingly, both the parties appeared before the mediator attached to the Kerala State Mediation and Conciliation Centre, Ernakulam. The dispute stands effectively settled and resolved. The parties, accordingly, signed a memorandum of agreement before the mediator. The said agreement is in the court files. The whole dispute stands resolved forever, the grievance of the 2nd
Crl.M.C.. No. 6550/2014 respondent stands redressed, she is now satisfied, and she does not want to proceed with the prosecution. I am well satisfied that the parties have really settled the dispute amicably, and that they are now on quite cordial terms. In such circumstances, the memorandum of agreement signed before the mediator can be accepted, and the prosecution can be quashed. In the result, this petition is allowed in terms of the memorandum of agreement signed by the parties before the mediator. Accordingly, the prosecution against the petitioner in C.C.No.1297/2012 of the Judicial First Class Magistrate Court-II, Kochi, will stand quashed under Section 482 Cr.P.C. Sd/- P. UBAID, JUDGE sd
