J U D G M E N T

The petitioner had filed the above original petition regarding the non-approval of a higher grade, which was sanctioned by the governing body, the 3rd respondent herein. At that point of time, there was no Service Rules applicable to the 3rd respondent. Subsequently, after filing of the original petition, it is submitted that the Service Rules have come into force and now the petitioner has a grievance that he has no avenues for promotion. The petitioner definitely could agitate such issue before the 3rd respondent itself.

Leaving open all such contentions, the writ petition would stand closed as infructuous.
