O R D E R
The revision petitioner is the complainant in S.T. No.2883 of 2008 on the files of the court of the Judicial Magistrate of First Class, Alathur. The court below convicted the accused under Section 138 of the Negotiable Instruments Act and sentenced him to imprisonment till the rising of the court and a fine of Rs.20,000/-. Being not satisfied with the quantum of sentence awarded, this revision petition had been filed.

3. When this matter has been taken up for hearing, the
Crl.R.P.121/2010 : 2 :
learned counsel for the revision petitioner has submitted that the accused had challenged the judgment of conviction and sentence passed by the trial court in appeal and the appellate court, as per judgment in Crl. Appeal No.128 of 2010 set aside the conviction and sentence passed by the trial court. In view of the above reason, this revision petition has become infructuous.
For the said reason, this revision petition stands closed.
