O R D E R

When the revision came up for hearing today, the counsel for the revision petitioner submitted that he may be permitted to withdraw this revision with liberty to file appeal before the Sessions Court as provided under proviso to Section 372 of the Code of Criminal Procedure. The above submission is recorded and the revision petition is dismissed as withdrawn with the above liberty. Office is directed to return the certified copy of the order of the court below produced to the counsel for the revision petitioner on getting necessary acknowledgment as per rules.

The Sessions Court may consider the delay in filing the appeal, taking into account the period lapsed by filing the revision before this court, while considering the delay condonation application.
