O R D E R

The petitioner herein is the 2nd accused in S.C No.1317/2008 of the Court of Session, Thrissur. The offences alleged against the petitioner are under Sections 366A and Section 376 r/w 511 of the Indian Penal Code. The allegation of attempted rape is seen made only against the 1st accused. The definite allegation against the petitioner herein is only under Section 366A IPC. Pending the proceeding he made a request before the trial court to discharge him. His request was dismissed by the learned trial judge. But the learned judge decided to frame charge against the 2nd accused by order dated 24.1.2915. The said order is under challenge in this revision. After disposal of the application for discharge the petitioner herein and the victim of offence came to terms amicably, and accordingly approached this Court to quash the prosecution as against the petitioner herein. The prosecution as against the petitioner (2nd accused) stands quashed by this Court as per

Crl.R.P No.380 of 2015 order in Crl.M.C No.3902/2015. In such a situation, this revision is need not proceed.
