This appeal is filed against the order of the Sub Court, Kasargode in E.A.No.69 of 2012 in E.P.No.88 of 2008 in O.S.No.103 of 2006. By order dated 29.6.2015, the case was referred for mediation at the District Mediation Centre, Kasargode. Accordingly the dispute was mediated and the parties have entered into an agreement dated 19.9.2015 settling the entire dispute between them. In the light of the settlement thus arrived, this appeal is disposed of directing that the parties will be governed by the terms of the settlement dated 19.9.2015 and as agreed the sale conducted in E.P.No.88 of 2008 mentioned above would stand set aside.

The appeal is disposed of accordingly.
