JUDGMENT
Ramachandran Nair, J.
In C.M.App. No.1207/2007 a Division Bench of this Court passed an order on 22.5.2013 condoning the delay on condition that the appellant pays Rs.2,000/- as cost to the Kerala State Mediation and Conciliation Centre and produces proof of payment within one month. It was also made clear that failing to make the payment, the application will stand dismissed. So far, the memo for paying cost has not been produced and hence the Registry has placed the matter before Court, for orders.
2. Learned Senior Government Pleader submitted that the requisitioning authority has informed that they have deposited the entire amount before the court below and they do not want to prosecute the appeal. In that view of the matter and in the light of the
LAA 1041/2007 conditional order passed by the Division Bench which has also worked out, the appeal itself is dismissed. No costs. (T.R. RAMACHANDRAN NAIR, JUDGE.) (P.V. ASHA, JUDGE.) kav/
