The matter comes up in the defects list today. The defect is that notice issued to the 2nd respondent has been returned with the postal endorsement "addressee left the station". The defect was notified. Since the appellant did not cure the defect, the matter was posted before the Registrar (Judicial) on 6.9.2013, on which date, there was no representation for the appellant before the Registrar (Judicial). That is why the matter comes up in the defect list.

When the matter is taken up today, none appears for the appellant. Accordingly, the appeal is dismissed for nonprosecution. Sd/- S. Siri Jagan, Judge.
